Is hash legal in the UK? Class B rules, penalties, HHC and CBD
By the Golden High teamUpdated 23 October 202610 min read
The legal framework
Is hash legal in the UK? No: cannabis resin is a Class B drug under the Misuse of Drugs Act 1971, and possessing it can mean up to 5 years in prison, an unlimited fine or both. Medical cannabis has been prescribable by specialist doctors since November 2018, but that changed nothing for recreational use. Here's what the law says, what really happens if you're stopped, and where CBD, HHC and THCA stand in October 2026, text by text.

Is hash legal in the UK? No, it's Class B.
Hash, or cannabis resin, is the compressed resin collected from the trichomes of the cannabis plant. If you want the full picture of how it's made and the styles you'll come across, we've covered it in what hash is and how it's made. In the UK, the legal question has a simple answer: resin is named in the law alongside the plant itself, and both are controlled.
There's no tolerated amount, no personal-use allowance and no THC percentage below which resin becomes legal. Possession, supply, production, import and export are all offences unless they're covered by a Home Office licence, which is never granted for recreational use.
- Classification: Class B, alongside herbal cannabis, ketamine and amphetamines.
- Main law: the Misuse of Drugs Act 1971, Schedule 2, Part II.
- Medical use: only on prescription from a specialist doctor, since 1 November 2018.
- Recreational use: illegal across England, Wales, Scotland and Northern Ireland.
Cannabis laws UK
Hash, Class B and the penalties.
The UK sorts controlled drugs into three classes, A, B and C, and the class sets the maximum penalties. Part II of Schedule 2 to the Misuse of Drugs Act lists "cannabis and cannabis resin" among Class B drugs, together with cannabinol and its derivatives. The government's own penalty table puts synthetic cannabinoids in the same class.
| Offence | Class A | Class B (hash, cannabis) | Class C |
|---|---|---|---|
| Possession | Up to 7 years, unlimited fine or both | Up to 5 years, unlimited fine or both | Up to 2 years, unlimited fine or both |
| Supply and production | Up to life, unlimited fine or both | Up to 14 years, unlimited fine or both | Up to 14 years, unlimited fine or both |
These are maximum sentences, not automatic ones: what a court actually hands down depends on the quantity, the circumstances and your record.
If you're caught with hash
What happens if the police find hash on you.
For a small amount, prison is rarely the first response. According to GOV.UK, the police can issue a warning or an on-the-spot fine of up to £90 if you're found with cannabis. That isn't a right, though: it's the officer's call, and the outcome depends on the quantity, the context and whether it's a first offence.
- First time, small amount: often a warning or an on-the-spot fine, at the officer's discretion.
- Repeat offences: the response can escalate, up to the maximum penalty for possession.
- Under 18: the police are allowed to tell your parent, guardian or carer.
- Quantity, bags or scales: can point to supply, which carries up to 14 years.
Behind the wheel: in the UK it's illegal to drive with certain levels of illegal drugs in your blood, even if your driving isn't affected. A conviction means at least a 1-year ban, an unlimited fine, up to 6 months in prison and a criminal record. Never drive after smoking.
What the official texts say
Five texts that frame the question.
The rules on hash, CBD and new cannabinoids in the UK sit in a handful of texts, all public. Here are the ones this article relies on, with links at the bottom of the page.
Misuse of Drugs Act 1971 · Schedule 2
Part II lists cannabis and cannabis resin as Class B drugs, with cannabinol and cannabinol derivatives. It's the base text for everything that follows.
Misuse of Drugs Regulations 2001 · regulation 2
Defines the "exempt product": a product not designed for administration to humans, from which the drug can't be readily recovered, and in which no component part contains more than one milligram of a controlled drug.
Home Office · hemp factsheet (updated 18 December 2025)
Licences cover fibre and seed only. The leaves and flowers of the plant remain controlled parts, whatever the variety.
ACMD · letter of 22 May 2025
The government's drug advisers recommend controlling HHC and related semi-synthetic cannabinoids, plus THCA, as Class B drugs.
Draft Misuse of Drugs Act 1971 (Amendment) Order 2026
The text that would bring HHC, HHCP, 10-OH-HHC, 11-OH-THC and the two THC acids into Class B. It comes into force 28 days after it's made.
Medical cannabis
Medical cannabis since 2018: what it does and doesn't allow.
Since 1 November 2018, specialist doctors have been able to prescribe cannabis-based products for medicinal use. The announcement made on 11 October 2018 is explicit: decisions are made case by case, only when a patient has a special clinical need that licensed medicines can't meet, and GPs can't prescribe them.
- Not a legalisation. The government stated that the change does not pave the way towards legalising cannabis for recreational use.
- Penalties unchanged. Unauthorised possession and supply carry the same Class B penalties as before.
- No self-prescription. Without a specialist prescription, a cannabis product with THC is treated like any other Class B drug.
Is CBD legal in the UK?
CBD in the UK: legal on paper, narrow in practice.
CBD (cannabidiol) itself isn't listed in the Misuse of Drugs Act, which is why CBD products are on sale in the UK. The catch is THC: even a trace of it is a controlled drug, and the UK doesn't use the 0.3% threshold applied to hemp in France. A product containing THC only escapes control if it meets the strict exempt product criteria.
The one-milligram rule
Under regulation 2 of the 2001 Regulations, no component part may contain more than 1 mg of a controlled drug, and the product must not be designed for human administration nor allow the drug to be readily recovered.
Flowers and leaves
The Home Office states that the leaves and flowers of the plant are controlled parts. Hemp licences only cover fibre and seed, so CBD flowers don't fit into that licensing route.
In practice, "CBD" on a label tells you nothing about the legal status of a smokable product in the UK. What matters is which part of the plant it comes from and whether it contains controlled cannabinoids.
Is HHC legal in the UK?
HHC and THCA: a ban on the way.
HHC is a semi-synthetic cannabinoid made in a lab from hemp extract; we explain what it is in our guide to HHC. In the UK it isn't named in the Misuse of Drugs Act yet, but that doesn't make it a free-for-all: the ACMD notes that psychoactive hexahydro derivatives fall under the Psychoactive Substances Act 2016. Here's how the file has moved.
22 May 2025
The ACMD recommends controlling HHC and related compounds as Class B. It also considers that control of THCA is now necessary.
20 August 2025
The Home Office minister accepts the recommendation on HHC, to be implemented when parliamentary time allows.
2026
A draft Order lists HHC, HHCP, HHCH, 9-, 10- and 11-OH-HHC, 10-OH-HHCP, HHC-C8, HHC-C9, 11-OH-THC and THC acids A and B as Class B drugs.
October 2026
At the time of writing, legislation.gov.uk still shows the Order as a draft, not yet made. It will come into force 28 days after it is.
To remember: THCA turns into THC when heated, which is why the ACMD wants it controlled. Neither HHC nor THCA is a "legal alternative" to hash in the UK.
UK vs France
Two neighbours, two different rulebooks.
Golden High ships from France, so the comparison matters. The two countries treat cannabis resin the same way, as a controlled drug, but they split on hemp and on new cannabinoids.
| United Kingdom | France | |
|---|---|---|
| Hash with THC | Class B drug | Narcotic (stupéfiant) |
| Hemp threshold | No 0.3% threshold; flowers and leaves controlled | Hemp tolerated under 0.3% THC, flowers included since December 2022 |
| HHC | Not yet named in the 1971 Act; draft Order pending | Narcotic since 13 June 2023 |
| THCA | Control recommended by the ACMD; in the draft Order | Narcotic since 3 June 2024 |
The French side, text by text, is in legal weed in France, and the THCA question is covered in what THCA is.
And Delta-P hash?
What this means for our Delta-P resins.
Our Delta-P resins are Delta-P (CBDX) versions of hash styles, under 0.3% THC and lab-tested, like the Piatella Delta-P 50 %. That 0.3% benchmark is French and European: as shown above, UK law doesn't use it. We don't claim that our products are legal in the UK, and we'd rather tell you straight than sell you a slogan. The full picture of the molecule is on our Delta-P page.

Your questions
Your questions on hash and UK law.
Is hash legal in the UK?
No. Cannabis resin is listed as a Class B drug in Schedule 2 of the Misuse of Drugs Act 1971. Possession, supply, production, import and export are offences without a Home Office licence.
What class is hash in the UK?
Class B, the same as herbal cannabis. The Act lists cannabis and cannabis resin together in Part II of Schedule 2, alongside cannabinol and its derivatives.
What are the penalties for hash possession in the UK?
Up to 5 years in prison, an unlimited fine or both. For supply or production, up to 14 years. For small amounts, police can issue a warning or an on-the-spot fine of up to £90.
Is HHC legal in the UK?
It isn't named in the Misuse of Drugs Act yet, but psychoactive versions fall under the Psychoactive Substances Act 2016 according to the ACMD. A 2026 draft Order would make HHC a Class B drug.
Is CBD legal in the UK?
CBD itself isn't a controlled drug, but THC is. A product containing THC must meet the exempt product criteria, including no more than 1 mg per component part. Flowers and leaves are controlled parts of the plant.
Is THCA legal in the UK?
The ACMD considered in May 2025 that its control is now necessary, and THC acids A and B appear in the 2026 draft Order as Class B drugs. It turns into THC when heated.
Can you get medical cannabis in the UK?
Yes, since 1 November 2018, but only on prescription from a specialist doctor, case by case, when licensed medicines can't meet a patient's clinical need. GPs can't prescribe it.
