Vape THC: what you can actually vape legally in France

Vaping

Is a vape THC product legal in France? No: THC is a controlled drug there, and only hemp-derived products containing less than 0.3% THC are tolerated. What you can vape is CBD e-liquid, pods made from hemp extracts under that threshold, or hemp flower in a vaporizer. Here's how to find your way around, what the disposable puff ban changed in 2025, and why street THC cartridges are a real danger.

Legal or banned?

Vape THC: banned in France.

In some countries that have legalised cannabis, you'll find "THC vape pens" in shops. Not in France. THC (delta-9-tetrahydrocannabinol) is classed as a controlled drug there, and the only tolerated framework is hemp: the decree of 30 December 2021 only allows varieties containing no more than 0.30% THC. An e-liquid, cartridge or pod loaded with THC above that threshold is therefore a controlled drug in France, whether it comes from a foreign website or a dealer.

The same goes for the molecules that served as "replacement THC": HHC, HHC-O and HHC-P have been classed as controlled drugs in France since 13 June 2023, followed by THCP, H4-CBD, HHCPO and others since 3 June 2024, by decisions of the ANSM (the French medicines agency). An "HHC vape" is therefore banned there too.

  • Banned in France: e-liquids and cartridges containing THC, HHC, THCP, H4-CBD and the other classed molecules.
  • Tolerated: hemp-derived products below 0.3% THC.
  • Banned since February 2025: pre-filled, non-refillable disposable vapes, whatever they contain.
  • Always: adults only, never before driving.

The alternatives

What you can vape instead: three families.

When you look for a CBD vape or a "weed vape", you'll come across three types of product that have little in common. The table sums up how they differ.

A dry herb vaporizer heats the flower without burning it: no combustion, so no smoke in the strict sense. For hash, we've written a practical guide: how to vape hash. And for the basics of vaping cannabinoids, read vaping cannabinoids: what you need to know.

CBD puffs

Disposable puffs, banned since February 2025.

French law no. 2025-175 of 24 February 2025, published in the Official Journal on 25 February, bans the sale and distribution of electronic vaping devices that are pre-filled and non-refillable, whether or not they have a rechargeable battery. Cartridges aren't affected.

The law refers to the definition in the French Public Health Code, which covers devices used to consume a vapour "containing, where applicable, nicotine". So the text makes no exception for nicotine-free puffs such as CBD puffs: a disposable puff is still a disposable puff.

24 February 2025

The law banning single-use electronic vaping devices is enacted.

25 February 2025

Published in the Official Journal; the ban comes into force.

Today

Only refillable devices or devices running on cartridges are still on sale.

Our pods, for their part, recharge via USB, with 1 ml refills sold separately.

What the sources say

EVALI, vitamin E acetate: what we learned.

In 2019, the United States went through a wave of serious vaping-related lung injuries, known as EVALI. It showed what can happen when you inhale a liquid whose composition you don't know. References at the bottom of the page.

CDC · figures as of 18 February 2020

2,807 hospitalised cases or deaths reported across all 50 states, and 68 confirmed deaths. 82% of hospitalised patients reported vaping products containing THC.

CDC · where the products came from

Among THC users who gave their source, 78% had obtained their products only through informal channels: friends, dealers, online or in-person sellers.

CDC · vitamin E acetate

Found in the lung fluid samples of 48 of the 51 EVALI patients tested, and absent in healthy people.

ANSM · February and June 2025

A warning about vaping psychoactive substances, including synthetic cannabinoids such as PTC, with teenagers hospitalised. And several hundred poisonings since 2024 from products sold as CBD, e-liquids included, whose composition didn't match the label.

The CDC recommends not using vaping products that contain THC, especially from informal sources. The lesson applies well beyond the United States: the danger comes first from what you don't know about what's in the cartridge.

Safety

CBD pod or THC vape pen: the safety rules.

  • No street cartridges and no THC vape pen ordered from abroad: that's exactly the profile of the products behind the EVALI outbreak.
  • No home-made mixes. The ANSM warns that DIY mixes increase the risk of poisoning.
  • No added oil in a pod or e-cigarette: an e-liquid device isn't made to take just any oil.
  • No product without a label or lab report: "CBD e-liquids" can hide synthetic cannabinoids.
  • Strength shown on the product and THC below 0.3%.
  • Lab report you can view, or linked to the batch.
  • Identified seller, adults only.
  • Rechargeable device, compliant with the disposable puff ban.

Dosing

Dose it puff by puff.

The upside of inhaling is that the effect comes on fast: Health Canada talks about immediate effects, compared with up to 2 hours for an ingested product. So you can adjust in real time, as long as you give each puff time to kick in. A concentrated pod is nothing like an e-cigarette you draw on non-stop.

1

One puff

Short and light, without holding the vapour in your lungs for long.

2

Wait

Let several minutes go by before deciding to take another: the effect can keep building.

3

Adjust

Only take another puff if you want to. Note what works for you for next time.

Key takeaway: never before driving, no mixing with alcohol, and one product at a time. If you're new to this, start with a moderate strength and a single puff.
